Each team’s Hunters and Monster play each other, the order is determined by seeding. The higher seed team picks to start Hunters or Monster, and the lower seeded team picks the map first. Each game rotates who picks the map and who is the Monster/Hunter, through the potential third match.

Example match:

Round 1 - Team 1 (Hunters) vs Team 2 (Monster)

Round 2 - Team 2 (Hunters) vs Team 1 (Monster)

In the event of a 1-1 tie there’s a third match, picks determined by seeding, as detailed above. The winner of this match determines who moves on.

The Twitch CHAPPiE Challenge T-Shirt Giveaway (the “Promotion”) will take place during the live broadcast of the Final Round of the CHAPPiE Challenge Tournament (the “Broadcast”) which can be seen on www.chappiechallenge.com or www.Twitch.tv./evolvegame (each a “Website”)on March 1, 2015 beginning at 3:00 pm Pacific Standard Time (“PST”), and ending at approximately 6:00 PST (the “Promotion Period”). Participants must have active and valid Twitter accounts and be followers of @Twitch’s profile to be eligible to participate. Employees and the immediate families of employees of the Promotion Entities (as defined below) their affiliates and subsidiaries are ineligible.  This Promotion is subject to federal, state and local regulations.  Limit (1) t-shirt per eligible Participant who meets the participation requirements as set forth below. Twenty (20) t-shirts are available in the Promotion. The Promotion is sponsored by Twitch Interactive, Inc., ("Sponsor"), 225 Bush St. Floor 6, San Francisco, CA 94104.

Participants must log into their Twitter accounts and watch the Broadcast during the Promotion Period by logging onto either Website.  At twenty (20) random times throughout the Broadcast, the announcer will invite Participants to post a Social Media message via Twitter (the “Call-to-Action”) that includes the hashtag “#CHAPPIEMOVIEGIVEAWAY” (the “Tweet”). Data rates may apply to participate in the Twitter Post Interaction. The first Participant to publically post an eligible Tweet following each Call-to-Action will be selected to receive one (1) t-shirt.  The Sponsor’s clock will be the official timekeeper of each Call-to-Action and Sponsor will unequivocally determine which Tweet is posted first after each Call-to-Action. All decisions of the Sponsor are final. Tweets generated by fraudulent means will be disqualified. Tweets must NOT contain subject matter which is, or could be considered, in the sole discretion of Promotion Entities, obscene, pornographic, violent (e.g., relating to murder, the sales of weapons, cruelty, abuse, etc.), defamatory, libelous, discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal (e.g., illegal gambling, underage drinking, substance abuse, computer hacking, etc.), offensive, threatening, profane, hateful, degrading, harassing, or otherwise unlawful, tortious or objectionable.  Incomplete, unreadable, or unintelligible entries will be disqualified.  All Tweets must be in compliance with the Sponsor’s terms of service http://www.twitch.tv/user/legal?page=terms_of_service and are subject to Twitter’s terms of service https://twitter.com/tos?lang=en.  Twitter is not associated with this Promotion and is not responsible for the administration and execution of the Promotion.

Sponsor reserves the right to substitute any t-shirt with an item of equal or greater retail value should the offered t-shirt become unavailable for any reason other than being claimed by a Participant. Following the Promotion, Participants who have been identified as submitting the first Tweet after each Call-to-Action (each a “Potential Recipient”) will be notified via Twitter by the Sponsor. Potential Recipients must respond as directed within twenty-four (24) hours or they will be ineligible to receive a t-shirt.  Unclaimed t-shirts, if any, will go un-awarded. In the event of a dispute as to the identity of a Potential Recipient, the Potential Recipient will be deemed the natural person in whose name the Twitter account associated with Tweet was opened.

Each participant irrevocably grants the Sponsor and its successors, assigns and licensees, the right to use such Participant’s name, likeness, voice, quotes, comments, Tweets, biographical information, photograph and/or image in any and all media for any purpose, including without limitation, advertising and/or promotional purposes as well as in, on or in connection with the Promotion or other promotions, and hereby releases the Sponsor from any liability with respect thereto.

Sponsor, Columbia TriStar Marketing Group, Inc.,  and each of their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies and each of their respective officers, directors and employees (collectively, the “Promotion Entities”) and the immediate family members, and/or those living in the same household of each, are ineligible to participate in the Promotion. The Promotion Entities shall have the right, in their sole discretion, to disqualify any individual who attempts to participate fraudulently, and the Promotion Entities reserve the right to prosecute any fraudulent participants to the fullest extent of the law.

Participants shall indemnify, defend and hold harmless the Promotion Entities and each of their respective parents, affiliates, divisions, subsidiaries, successors, assigns and licensees, and each of their respective employees, shareholders, officers, directors, contractors, advertising and promotion agencies, agents and representatives (collectively, the “Released Parties”) from and against any and all liability, claims, loss, damage, injury or expense, including reasonable outside attorneys’ fees, arising out of or in connection with any third-party action arising out of or resulting from (i) participation in the Promotion and/or (ii) acceptance, possession, use or misuse of any item awarded in connection with the Promotion, including without limitation, personal injury, death and property damage arising therefrom.

The Released Parties shall not be liable for: (a) lost, damaged, or stolen item(s) awarded in connection with the Promotion; (b) any and all losses, damages, rights, claims and action of any kind in connection with or resulting from participation in the Promotion; (c) acceptance, possession, grant, or use of any item awarded in connection with the Promotion, including without limitation, personal injury, death and property damage arising there from; (d) claims based on publicity rights, defamation or invasion of privacy; or (e) any printing, typographical, human administrative or technological errors in any materials associated with the Promotion. Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Promotion (or any portion of the Promotion) should a virus, bug, computer problem, unauthorized intervention or other cause or problem corrupt or inhibit the participation or security of the Promotion in its entirety or at any given location. In the event the Broadcast is cancelled or postponed for any reason, Sponsor reserves the right to (a.) change the date and/or time of the Promotion to coincide with a future Broadcast or (b.) cancel the Promotion entirely. Sponsor may prohibit an otherwise eligible participant from participating in the Promotion or receiving a t-shirt if, in its sole discretion, it determines that such participant is attempting to undermine the legitimate operation of the Promotion by cheating, deception, or any other unfair practices or intending to annoy, abuse, threaten or harass any other participants or Sponsor's representatives.

This Promotion is governed by the laws of the United States and the State of New York, without respect to any choice of law or conflict of law principles that would result in the application of any law other than that of New York.  As a condition of participating in this Promotion, participants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Promotion, shall be resolved individually through binding arbitration, without resort to any form of class action, in accordance with the arbitration provision set forth below.

By participating in this Promotion, each Participant agrees that any and all disputes the Participant may have with, or claims entrant may have against, the Released Parties relating to, arising out of or connected in any way with (i) the Promotion, (ii) the awarding or redemption of any t-shirt, and/or (iii) the determination of the scope or applicability of this agreement to arbitrate, will be resolved individually and exclusively by final and binding arbitration administered by the National Arbitration Forum (the “Forum”) and conducted before a sole arbitrator pursuant to the Code of Procedure established by the Forum. The arbitration shall be held at a location determined by the Forum pursuant to the Code of Procedure, or at such other location as may be mutually agreed upon by the participant and Sponsor. The arbitrator's decision shall be controlled by these Terms and Conditions and any of the other agreements referenced herein that the applicable Participant may have entered into in connection with the Promotion. There shall be no authority for any claims to be arbitrated on a class or representative basis; arbitration can decide only the Participant's and/or Sponsor's individual claims and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated. The arbitrator shall not have the power to award special or punitive damages against the Participant or Released Parties. If any part of this Arbitration Provision is deemed to be invalid or otherwise unenforceable or illegal, the balance of this Arbitration Provision shall remain in effect and shall be construed in accordance with its terms as if the invalid or illegal provision were not contained herein.

This Promotion is in no way sponsored, endorsed or administered by Twitter. Twitter is completely released of all liability by each Participant in this Promotion.

Terms and Conditions

NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW. THIS IS A SKILL-BASED CONTEST. The following promotion is intended for participants in the United States only and shall be construed and evaluated according to the laws of the United States. Do not proceed in this promotion if you are not a legal resident of the United States. By entering and participating in this Tournament, you and all members of your registered Team agree to be bound by these Official Rules and represent that you and all members of your registered Team satisfy all of the eligibility requirements set forth below. Further eligibility restrictions are contained in the official rules ("Official Rules") below.

 

1. DESCRIPTION: The "CHAPPiE Challenge Tournament" (the "Contest" or “Tournament”) is a skill-based video game tournament which will be played using Xbox One hardware, Xbox Live online software and the video game Evolve. The sponsor of this Contest is Twitch Interactive, Inc., ("Sponsor"), 225 Bush St. Floor 6, San Francisco, CA 94104. The administrator of the Contest is Creative Zing Promotion Group (“Administrator”), 189 S. Orange Avenue, Ste. 1130A, Orlando, FL 32801. Columbia TriStar Marketing Group, Inc. (the “Presenter”) is not responsible for the collection of data, the administration of the Tournament, or the selection of the winners. Entrants are providing their information to Sponsor and not to Presenter. “Contest Entities” shall be defined as Sponsor, Administrator, and Presenter collectively.

 

The Contest will flow as follows:

      "Registration Period": Users may register for the Tournament beginning on or about February 10, 2015 (“Announcement Date”) through February 20, 2015 at 11:59:59 pm Pacific Time ("PT”) as directed below in Section Three (3).

      Bracket Play Period”: Players must be logged in and ready to play at 12:00 pm PT on February 21, 2015. (“Start Time”) The Bracket Play Period will begin at Start Time and end when the final two Teams remain in the bracket. Tournament play is further described in Section Four (4) below.

      “Final Round”: The final two Teams in the Tournament (each a “Finalist Team”) will be flown to Los Angeles, California to compete against each other in a live-streamed Final Round to determine the “Winning Team” and the “Runner’s Up”, as detailed in Section Six (6) below.

      “CHAPPiE Challenge”: The Winning Team will play against “CHAPPiE” in a live-streamed game following the Final Round, as detailed in Section Seven (7). CHAPPiE is a fictional character therefore CHAPPiE’s actual game play will be performed by a Game expert to be selected by the Sponsor. The CHAPPiE Challenge will be for entertainment purposes only and will have no impact on the final results of the Tournament.

 

2. ELIGIBILITY: This Contest is open only to legal residents of the forty-eight (48) contiguous United States and the District of Columbia, who are physically located and residing therein and who meet the following criteria:

 

      Entrant must be at least eighteen (18) years of age and the age of majority in his or her state of primary residence at the time of entry ("Entrant");

      Entrant must own or have authorized access to an Internet-enabled Xbox One console as of the Announcement Date and through the end of the Bracket Play Period;

      Entrant must have an active and valid Xbox Live® account in good standing as of the Announcement Date and through the end of the Bracket Play Period;

      Entrant must own or have authorized access to the video game Evolve (“Game’) on Xbox One format as of Announcement Date and through the end of the Bracket Play Period;

      Entrant must be the rightful owner of the Xbox Live® account used for game play; and

      Entrant must be a registered member of the Electronic Sports League (“ESL” or “Tournament Director”) website. You may register for membership for free by logging on to http://chappiechallenge.com and following the onscreen prompts to create an ESL profile.

 

ENTRANTS, IF PLAYING FOR ONE (1) OF THE TWO (2) FINALIST TEAMS, MUST BE AVAILABLE TO TRAVEL FROM FEBRUARY 28 – MARCH 2, 2015. This Contest is not intended to solicit purchase of any materials required for play. Any individuals who purchase an Xbox Live® membership after the Announcement Date will not be eligible for play. Any individuals (including but not limited to employees, consultants, independent contractors and interns) who have, within six months prior to the start date of the Registration Period, held employment with or performed services for Contest Entities, ESL, 2K Games, Turtle Rock Studios, Columbia TriStar Marketing Group, Inc. (“CTMG”) or for any of the agencies associated with the Contest or for each of their respective parents, affiliates, subsidiaries, advertising and promotion agencies, agents, directors, officers and distributors of any of the foregoing entities are not eligible to enter or win. Immediate family and household members of such individuals are also not eligible to enter or win. For purposes of the Contest, "Household Members" shall mean those people who share the same residence at least three months a year and "Immediate Family Members" shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. Void in Alaska, Hawaii, Puerto Rico, all U.S. territories and possessions, and where prohibited by law.

 

3. TOURNAMENT REGISTRATION: To register for the Tournament, one (1) Entrant from each prospective team must complete the following steps:

    Visit the Tournament registration website at http://chappiechallenge.com (“Website”) and login to your ESL profile. If you do not have an ESL profile you must follow the onscreen prompts to register an ESL account.

    Be sure to associate your Xbox Gamertag with your profile using the 'Game ID' widget at the top of the page.

    Follow the onscreen prompts to create a team profile.

    After the team profile has been created, a registration link will be provided via the “Manage Members” button at the top of the page. Use this registration link to invite three (3) additional members to join your “Team” (each a “Player”, “Entrant”, or “Team Member”). All Players must have registered ESL accounts in order to join the Team.

    Players who have been invited to join a Team must click the Team’s registration link and follow the onscreen prompts to join the Team.

    All members of the Team must meet the Tournament registration and eligibility requirements.

    Teams must have four (4) eligible Players listed on the team profile in order to sign-up for the tournament.

    Once all four (4) Team Members have followed the onscreen prompts to join the Team, click the “Sign Up” button on the Website and follow the prompts to add the Team to the Tournament.

    Registration must be received by February 20, 2015 at 11:59:59 pm PT.

    Following successful registration for the Tournament and before the Bracket Play Period begins, each Player will receive a “Notification Email” at the address listed in his or her ESL profile with detailed instructions including but not limited to:

o          Tournament play and log-in procedures

o          Match start times

o          How to report match results following each bracket

o          How to contact a Tournament Administrator

 

During the Registration Period and throughout the duration of the Tournament, the Website will serve as a hub of information for Players regarding all aspects of the Tournament. Players are invited to logon to the Website frequently throughout the Bracket Play Period to access:

o        Tournament Updates

o      Bracket Information (i.e., each Team’s opponent, match start times, scores, elimination information etc.)

o        Access to Tournament Administrators

 

4. BRACKET PLAY PERIOD: The Tournament will consist of one (1) single-elimination bracket to be played sequentially until only two (2) Finalist Teams remain. Teams will be registered on a first-come-first-served basis; the maximum number Teams eligible to participate in the Tournament is 2,048. All Teams will be randomly seeded into the brackets prior to the Bracket Play Period, and the size of the bracket will be variable depending upon the number of eligible Teams who register. In the event that the number of Teams registered for the Tournament is incompatible with standard bracket organization, those Teams which are not randomly seeded into the first round will be randomly seeded into the second round.

 

The Bracket Play Period will begin at 12:00 pm PT on February 21, 2015. Entrants must follow the instructions listed in the Notification Email to login for the Tournament and meet their opponents online for play. Contest play will take place using Xbox One hardware and must be played using Xbox Live® online software.

 

Each bracket match will consist of two (2) Teams facing off by playing a minimum of two (2) and maximum of three (3) games of the video game Evolve (the “Game”). Play will occur according to the standard manufacturer rules governing the Game, as determined in the sole discretion of the Sponsor, with the following settings turned OFF:

o        Mastery Bonus

o        Character Perks

o        Elite Wildlife

 

Each Team must be logged in and ready to play within thirty (30) minutes of their scheduled bracket match’s start time. All four (4) Players from each Team must be present. In the event that one (1) or more Player from a Team is absent, then that Team must forfeit the match.

 

Each Team will take a turn playing “Hunter” and “Monster” modes. The higher seeded Team will decide who plays Monster and Hunter for the first game, and then the Teams will switch roles for the second game. In the event that each Team wins one (1) of the games, they will then play a third game tie-breaker. In that event, the Teams will switch roles again, so that the roles will be the same as were played in the first game. The Team which loses two (2) games will be eliminated from the Tournament, the Team which wins two (2) games will advance.

 

Following the end of each bracket match, each Team must report the final score by logging onto the Website and either:

(A)  Clicking through to the “Bracket Page”, clicking their Team’s “vs.” match icon and following the prompts to report the score; or

(B)Accessing the Tournament Information module at http://chappiechallenge.com/tournament/ and following the prompts to report the score.

 

The winning Team will automatically move on to the next round and can find details about the start time and their next opposing Team by accessing the Bracket page.

 

In the event that the duration of the Bracket Play Period exceeds seven (7) consecutive hours, the next round will be suspended and will be scheduled to recommence at 12:00 pm PT on February 22, 2015. In this event, details will be posted on the Bracket Page in real time.

 

In the event that one Team fails to list the score following a match, a representative of the Tournament Director (a “Tournament Administrator”) will allow a fifteen (15) minute grace period, after which he or she will investigate the match by reaching out to one or more of the Players. If neither Team reports a score within one (1) hour after a match has ended then both Teams will be disqualified from the Tournament.

 

Tournament Director and Sponsor are not responsible for any Entrant’s inability or failure, for any reason, to participate in any round within the timeframe determined by the Tournament Director. In the event of Tournament play disruption, whether by technical problem or any other means, reasonable effort should be made to recover the round already in progress and continue Tournament play. In the event that the round cannot be recovered or resolved, the Tournament Director reserves the right to declare a winner, reschedule the round, or disqualify a Team at its sole discretion. The course of action will be decided in the sole discretion of the Tournament Director. If any Entrant intentionally disrupts Tournament play, his or her Team will be automatically disqualified and thus be eliminated. All decisions of Sponsor and Tournament Director with regard to proper Tournament play are final and binding. In the event of a final score dispute, each Team should present visual proof (i.e. screenshot, digital photo, etc.) and send it to a Tournament Administrator via the Website.

 

NOTE: Proper language, behavior, and etiquette are mandatory at all times.  Failure to comply may result in removal from the Tournament. In no event is vulgarity, profanity or lewd or offensive language or behavior allowed. Sponsor, Tournament Director and all Entrants are to be respected at all times.

 

Sponsor and Tournament Director reserve the right to adjust the Tournament schedule/format, proceed with fewer Entrants or to extend the Registration Period, if applicable, to secure a sufficient number of available Entrants for the duration of the Tournament.

 

The Sponsor and Tournament Director, in their sole and unfettered discretion, may reject or disqualify any Entrant at any time (whether before or after game play has commenced or any winners have been determined) if the Tournament Director believes that such Entrant does not meet the eligibility criteria, has violated these Official Rules, engages in inappropriate, disruptive, or abusive conduct or behavior, or otherwise is not appropriate for the Contest. In addition to these Official Contest Rules, Entrants are also subject to modifications or clarifications to these Official Rules as posted by the Sponsor from time to time, and the Sponsor’s Terms of Service posted at http://www.twitch.tv/user/legal?page=terms_of_service. Sponsor will not provide customer service for any issue related to related hardware or software. Entrants who require customer service for Game-related issues must contact the Game publisher, as any purchaser would. Each Entrant must be the rightful owner of the Xbox Live® account used for game play. In the event of a dispute as to the identity of a winner, the winner will be deemed to be the person in whose name the Xbox Live® account was opened. Entrants are expressly forbidden from using multiple Xbox Live accounts to participate in the Contest. Any Entrant suspected or discovered to have used or be using multiple accounts in the course of the Contest may be immediately disqualified and/or have such accounts terminated. By entering the Contest each Entrant acknowledges and agrees that Sponsor and Tournament Director shall have the right to access and use such Entrant's account information (and any personal information associated therewith) if Sponsor and/or Tournament Director reasonably believe that such Entrant has competed using multiple accounts.

 

5. FINALIST DETERMINATION & NOTIFICATION: Pending verification of their members’ eligibility, the two (2) Teams remaining at the end of the Bracket Play Period will be declared the Finalist Teams (each Finalist Team Member a “Finalist”). All members of each potential Finalist Team will be notified via email at the email address listed in their ESL profiles on or about February 23, 2015. Finalists will be required to respond (as directed) to the notification within twenty-four (24) hours of first attempted notification. The failure to respond timely to the notification may result in disqualification of his or her Team. Finalists will be required to verify eligibility and to execute before a notary public and return within twenty-four (24) hours an affidavit of eligibility, a liability release and, unless prohibited by law, a publicity release (collectively, the “Prize Claim Documents”) covering eligibility, liability, advertising, publicity and media appearance issues, unless prohibited by law. Each Finalist must provide Contest Entities with a valid social security number for tax reporting purposes before they will be eligible to proceed in the Tournament. As required by law, an IRS Form 1099 will be issued in the name of each Finalist in January, 2016. The failure of any Finalist to respond timely to the notification may result in his or her Teams’ elimination from the Tournament, in such case, Administrator may select an alternate Finalist Team according to the bracket results. No Finalist Team will move forward in the Tournament until all such properly executed forms are returned.

 

6. FINAL ROUND: The Final Round of the Tournament will take place in Los Angeles, California on March 1, 2015. The two (2) Finalist Teams will face off in-studio for a best-of-three elimination match that will be streamed live via twitch.tv/evolvegame. The rules of the Final Round will be identical to those set forth in the Bracket Play Period of the Tournament. The team which wins two (2) games will be declared the First Place Winner, the team which loses (2) games will be declared the Second Place Winner. All Team Members will be required to execute an additional prize claim form regarding liability, eligibility, and publicity before any prizes will be awarded.

 

All four (4) Players of each Team must be present in order to participate in the Final Round. Tournament Director and Sponsor are not responsible for any Player’s inability or failure, for any reason, to participate in the Final Round. In the event of play disruption after the Final Round has commenced, whether by technical problem or any other means, the Tournament Director reserves the right to declare a winner, restart the round, or disqualify a Team at its sole discretion. The course of action will be decided in the sole discretion of the Tournament Director. If any Entrant intentionally disrupts Tournament play, his or her Team will be automatically disqualified and thus be eliminated. All decisions of Sponsor and Tournament Director with regard to proper Tournament play are final and binding.

 

7. CHAPPiE CHALLENGE: After the results of the Final Round have been confirmed, the First Place Team will face off against “CHAPPiE” in a demonstration match following the same Game rules as set forth in all previous rounds of the Tournament. The match will occur in-studio directly following the Final Round, and will be live-streamed on twitch.tv/evolvegame. The final score of the CHAPPiE Challenge will have no impact on the results of the Tournament. As “CHAPPiE” is a fictional character, his game play will be performed by a Game expert, to be selected by the Sponsor in its sole discretion. The CHAPPiE persona will be represented using CGI technology, and will be visible only to viewers watching the match via Twitch.tv.

 

8. PRIZES:

 


Finalist Prizing

Eight (8) Finalist Prizes are available, each consisting of a 3-day /2-night trip (“Trip”) to Los Angeles, California to participate in the Final Round of the Tournament.   Each Trip will consist of the following:

 

(a.) Round-trip coach class airfare for the one (1) Finalist from a major airport with regularly scheduled commercial flights closest to the Finalist’s permanent residence to a Los Angeles, CA-area airport (or, in Sponsor’s sole discretion, $500 in lieu of air travel if winner lives within a 200-mile radius of Los Angeles, CA);

 

(b.) two (2) nights hotel accommodation at a hotel selected by the Sponsor (one room, double occupancy, room & tax only);

 

(c.) airport transfers between the airport and hotel in Los Angeles; and

 

(d.) ground transportation between the hotel and the Final Round (the “Event”), if applicable, based on the proximity of the hotel to the Event.

 

Approximate Retail Value (“ARV”) of each Finalist Prize:  $1,900

First Prize (1)

One (1) First Prize is available. First Prize consists of fifteen thousand dollars ($15,000) U.S. currency, to be distributed evenly among each of the four (4) members of the First Place Team.

One (1) Second Prize is available. Second Prize consists of five thousand dollars ($5,000) U.S. currency, to be distributed evenly among each of the four (4) members of the Second Place Team.

FINALIST TRAVEL WILL TAKE PLACE FROM FEBRUARY 28 – MARCH 2, 2015. ACTUAL DATES WILL BE DETERMINED AT THE SOLE DISCRETION OF THE SPONSOR. Actual Finalist Prize value depends on each Finalist’s place of residence and cost and availability of airfare and hotel at time of booking and travel and may be substantially higher or lower than estimated value. Contest Entities will not obtain travel insurance on behalf of any Finalist. For the avoidance of doubt, each Finalist shall be solely responsible for all expenses not specifically set forth herein, including but not limited to meals, beverages, gratuities, tips, additional ground transportation expenses, telephone charges, taxes, incidentals and other personal expenses. Trip must be taken on the dates specified by Sponsor and failure to travel during the specified times will result in forfeiture of the prize. Travel is subject to flight and hotel availability and blackout dates and other travel restrictions may apply. Each Finalist is responsible for all applicable travel and other insurance, all applicable airport charges, including, without limitation, any baggage charges, airport taxes, fuel charges and any applicable federal inspection fees. Sponsor reserves the right to change travel dates and to substitute any or all of these portions of the prize for a prize of comparable or greater value should they become unavailable or impractical for any reason. Contest Entities are not responsible for lost or stolen tickets and/or travel documents and no replacements will be issued. If the Event is cancelled or postponed for any reason, Sponsor reserves the right, in its sole discretion, to change the dates of the Trip to accommodate an alternate Event date, if applicable. ALL FEDERAL, STATE AND LOCAL TAXES, AND ANY OTHER COSTS AND EXPENSES, ASSOCIATED WITH THE RECEIPT OR USE OF THE PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER.

Prize winners cannot assign or transfer any prize to another person, except at discretion of Sponsor. If a prize cannot be awarded due to circumstances beyond the control of Sponsor, a substitute prize of equal or greater retail value will be awarded; provided, however, that if prizes are awarded but unclaimed/forfeited by recipient, prize may not be re-awarded, in Sponsor’s sole discretion. Other restrictions may apply. Limit one prize per household. All prizes are awarded WITHOUT WARRANTY OF ANY KIND, express or implied, without limitation.

 

9. CONDITIONS OF PARTICIPATION/RELEASES: All federal, state and local laws and regulations apply. By participating, each Entrant agrees to be bound by these Official Contest Rules and the decisions of the Sponsor, which shall be final in all respects. By participating in this Contest and/or by accepting any prize, each Entrant agrees to release the Contest Entities, Tournament Director, 2K Games, Turtle Rock Studios, CTMG and each of their respective successors, employees, agents, and representatives, and each of their respective subsidiaries, affiliates, owners, shareholders, officers, directors, agents, and employees (collectively the "Released Parties") from any and all actions, claims, injuries, death, losses or damages arising in any manner, directly or indirectly, from participation in this Contest and/or acceptance or use of a prize. Prize Providers are not responsible for the promotion, administration, or fulfillment of this Contest. Each winner authorizes the Contest Entities to use his/her photo, video, name, voice, likeness, biographical data, city and state of residence in advertising, marketing, programming or promotional materials, worldwide in perpetuity, and on a winners’ list, if applicable, without further compensation unless prohibited by law. Winners may be asked to participate in select publicity activities, as determined at the sole discretion of the Contest Entities. Contest Entities are not obligated to use any of the above-mentioned information or publicity materials, but may do so and may edit such information or materials, at Contest Entities sole discretion, without further obligation or compensation. The Released Parties shall not be liable for: (i) any injuries, losses, liabilities or damages of any kind including personal injury or death caused by the prize or resulting from acceptance, possession or use of a prize or from participation in the Contest; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) late, lost, delayed, stolen, misdirected, postage-due, incomplete, unreadable, inaccurate, garbled or unintelligible entries, communications or affidavits, regardless of the method of transmission; (v) any inability of winner to accept or use any prize (or portion thereof) for any reason and such prize or portion thereof shall be forfeited; or (vi) any printing, typographical, human administrative or technological errors in any materials or activities associated with the Contest. Contest Entities disclaim any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Contest or use of a prize. Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Contest (or any portion of the Contest) at any time for any reason or should a virus, bug, computer problem, unauthorized intervention, extenuating circumstance or other problem/cause corrupt or inhibit the administration, security or proper play of the Contest and, in such situation, will select the winner from eligible non-suspect entries received prior to and/or after such action or in such manner as deemed fair and appropriate by the Sponsor. Sponsor may prohibit Entrant from participating in the Contest or winning a prize if, in its sole discretion, it determines Entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or any other unfair practices or intending to annoy, abuse, threaten or harass any other Entrants or Contest Entities representatives. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE CONTEST. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

 

10. INDEMNITY:  Winners shall indemnify, defend and hold harmless the Released Parties from and against any and all claims, damages, actions, liability, loss, injury or expense, including reasonable attorneys’ fees and costs, arising out of or in connection with: (a) any winner’s participation in the Contest; (b) a breach or allegation which if true would constitute a breach, of any winner’s representations, warranties or obligations herein; and  (c) acceptance, possession, grant, or use of any prize, including without limitation, personal injury, death and property damage arising there from.

 

11. DISPUTES: This Contest is governed by the laws of the United States and the State of New York, without respect to any choice of law or conflict of law principles that would result in the application of any law other than that of New York.  As a condition of participating in this Contest, Entrants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Contest, shall be resolved individually through binding arbitration, without resort to any form of class action, in accordance with the arbitration provision set forth below.

 

12.  ARBITRATION PROVISION:  By participating in this Contest, each entrant agrees that any and all disputes the entrant may have with, or claims entrant may have against, the Released Parties relating to, arising out of or connected in any way with (i) the Contest, (ii) the awarding or redemption of any prize, and/or (iii) the determination of the scope or applicability of this agreement to arbitrate, will be resolved individually and exclusively by final and binding arbitration administered by the National Arbitration Forum (the “Forum”) and conducted before a sole arbitrator pursuant to the Code of Procedure established by the Forum.  The arbitration shall be held at a location determined by the Forum pursuant to the Code of Procedure, or at such other location as may be mutually agreed upon by the participant and Sponsor.  The arbitrator’s decision shall be controlled by the terms and conditions of these Official Rules and any of the other agreements referenced herein that the applicable participant may have entered into in connection with the Contest.  There shall be no authority for any claims to be arbitrated on a class or representative basis; arbitration can decide only the participant’s and/or Sponsor’s individual claims and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated.  The arbitrator shall not have the power to award special or punitive damages against the participant or Released Parties.  For more information on the Forum and/or the Forum's Code of Procedure, please visit their website at www.arb-forum.com.  If any part of this Arbitration Provision is deemed to be invalid or otherwise unenforceable or illegal, the balance of this Arbitration Provision shall remain in effect and shall be construed in accordance with its terms as if the invalid or illegal provision were not contained herein.

 

13. PRIVACY POLICY: By entering the Contest, Entrant understands that information is being collected by Sponsor. The information provided to Sponsor will only be used by Sponsor as provided in Sponsor’s privacy policy. By entering the Contest, you grant Sponsor permission to correspond with you via email and to share your email address and any other personally identifiable information with the corresponding Contest Entities solely for the purpose of Contest administration, communication and fulfillment. Sponsor will not sell, rent, transfer or otherwise disclose your personally identifiable information to any third party other than the corresponding Contest Entities as described herein.

 

14. WINNERS’ LIST/OFFICIAL RULES: To obtain the list of the winner(s) or a copy of these Official Rules, send a request along with a stamped, self-addressed envelope to “CHAPPiE Challenge Tournament” Winners’ List/Rules, 189 S. Orange Ave, Suite 1130A, Orlando FL 32801. Requests for the name of the winner(s) must be received no later May 1, 2015. Vermont residents may omit return postage.
